Car accident and traffic injury

Injured in a car accident?

All registered cars must have insurance that covers personal injury, even when no one is at fault. It covers drivers, passengers, cyclists and pedestrians. We find out whether you are entitled to compensation, and pursue the case against the insurance company.

You pay nothing.

We take cases where the insurance company covers the lawyer. If it does not cover your case, you get a price quote first. You can say no.

Describe what happened

Write in your own words. You don't need to know the legal terms.

It costs nothing to send. Lawyers are bound by confidentiality about what you write, even if it does not become a case.

Four things many people believe that are not true

Many people do not claim compensation because they have heard something that is wrong. Here is what the law and the Supreme Court say.

Many believe

“I was driving, and it was my fault.”

You are covered as a driver too. The car's insurance covers personal injury even if no one is at fault. Compensation may be reduced if you contributed to the injury yourself, but not when you are only slightly to blame. If you were driving under the influence, as a general rule you do not get compensation.

Motor Vehicle Liability Act (bilansvarslova) §§ 4 and 7

Many believe

“Someone I know was driving. I don't want to demand money from them.”

Your claim goes to the insurance company, not to the driver. The company can only recover the money from the driver in special cases, such as intent, gross negligence or driving under the influence.

Motor Vehicle Liability Act (bilansvarslova) §§ 4 and 12

Many believe

“The car drove off, or had no insurance.”

Then the insurance companies are jointly liable through the Norwegian Motor Insurers' Bureau (Trafikkforsikringsforeningen). This applies to personal injury even when no one knows which car it was.

Motor Vehicle Liability Act (bilansvarslova) § 10

Many believe

“It's only my neck. You don't get compensation for that.”

Yes, you do, when four conditions are met. The accident must have been forceful enough to cause injury. You must have had neck pain within two to three days. The symptoms must have lasted continuously since. The course must match what doctors know about such injuries. We assess whether your case meets the conditions.

What it costs you

The insurance company usually covers reasonable and necessary legal costs when it is liable for the injury. Our service is built on that.

NOK 0

for the assessment

You describe what happened. A lawyer assesses whether you have a case. It costs nothing, whatever the answer.

NOK 0

when the insurance company covers the case

We take cases where the insurance company covers the legal costs. We ask the company to confirm this before we start. The bill goes to the company, not to you.

Price first

when the case is not covered

If the company denies liability, it normally does not cover the lawyer either. Then you get a written price quote. We do not charge until you have accepted it. If you say no, you owe us nothing.

We never take a share of your compensation. You never get a bill you have not accepted in advance.

Where are you in your case?

Find what resembles your situation. You can contact us wherever you are.

  1. 1The first three days

    The accident has just happened

See a doctor, even if you think it will pass. Mention all symptoms, especially in the neck and head. If anyone is more than slightly injured, the police must be notified. Take photos, and write down the names of witnesses.

We tell you what must be reported, and to which company.

  2. 2The first weeks

The personal injury has not been reported

Damage to the car and injury to you are two separate cases. The personal injury must be reported separately to the insurance of the car you were in or were hit by. If you have your own accident insurance, the claim there must be reported within one year.

We find the right company and report the injury. If the car is unknown or uninsured, we report to Trafikkforsikringsforeningen.

  3. 3The first year

    You are losing income

Sickness benefit does not cover income above six times the basic amount (G), and NAV pays for 248 days. Work assessment allowance (AAP) is 66 percent of the basis. What you lose, you can claim from the insurance company.

We claim lost income and expenses along the way. The company must pay an advance when it is clear that it will pay part of the claim.

  4. 4When the injury is stable

A specialist is going to assess you

The specialist report is used to assess how severe the permanent injury is, and whether it was caused by the accident. Talk to us before the specialist is chosen.

We review the choice of specialist and the questions the specialist is asked.

  5. 5When the company replies

    The company has said no

The company may argue that the symptoms were not caused by the accident. Send us the letter. If the refusal concerns accident insurance, you have six months to take it further after a written refusal.

We assess the refusal against the conditions set by the Supreme Court, and whether the case should go to the Norwegian Financial Services Complaints Board (Finansklagenemnda) or to court. If the company does not cover the lawyer here, you get a price quote first.

  6. 6At settlement

    You have received an offer

As a general rule, compensation is paid as a lump sum. Do not reply before a lawyer has looked at the offer. Send it to us.

We check the amount against what the law entitles you to: lost income, future loss of income, expenses, loss of ability to work in the home and compensation for permanent injury (ménerstatning).

Three deadlines you should know

3 days

to have your neck pain recorded by a doctor

This is not a statutory deadline. The Supreme Court requires that the neck pain appeared within two to three days of the accident. The medical record is the best evidence.

Supreme Court of Norway, HR-2018-557-A

1 year

to report a claim to your own accident insurance

The deadline runs from when you became aware of the circumstances giving rise to the claim.

Insurance Contracts Act (forsikringsavtaleloven) § 18-5

3 years

before the claim against the car's insurance becomes time-barred

The deadline runs from when you gained, or should have obtained, the necessary knowledge of the injury and who is liable. The claim becomes time-barred after 20 years at the latest.

Limitation Act (foreldelsesloven) § 9

Frequently asked questions

The accident happened several years ago. Is it too late?

Not necessarily. The claim against the car's insurance becomes time-barred three years after you gained, or should have obtained, the necessary knowledge of the injury and who is liable. If you reported the injury to the company in time, separate rules apply. Describe your case, and we will assess it.

I was hit as a cyclist or pedestrian.

The car's insurance covers your personal injury, even when the driver is not at fault. Compensation can only be reduced if you contributed to the accident yourself and are more than slightly to blame.

I was injured while driving for work.

Then the injury may also be an occupational injury. We assess both sets of rules. Read more on our page about injuries at work.

My child was injured.

Children and young people under 19 have special rules for compensation for future loss of income. The rules change on 1 January 2027. Get in touch, and we will explain what applies to your child.

What if the insurance company covers only part of the legal costs?

Then we tell you before we do more work. You get a price quote for the rest, and we only continue if you accept it.

Do I need to have my papers ready before I get in touch?

No. Describe what happened. We tell you which papers we need, and where to find them.
